NHL Cease and Desist Order
Posted by Mother Pucker on February 2nd, 2009Ok there have been a lot of people questioning me about my tweet that said “Just got hammered with a cease and desist order from the NHL.” I didn’t really have all the info I needed at the time so couldn’t really elaborate, but I managed to speak with legal representation at the NHL this morning, and now have everything cleared up. Here is a copy of the letter that they sent me:

I called Kelley A. Lynch this morning, and she told me that there was no issue with any content on this website, and it was strictly the links that I was posting to the streaming hockey games. She said that if I removed them there would be no issue, so I proceeded to do so.
So now, there are no more streaming hockey links available through this site. It’s a sad state for some I’m sure as I’ve had a truckload of emails coming in asking where they went, when they are coming back, etc… but now you know the reason they disappeared, and that they aren’t coming back. Sucks, I know.
Anyway, there you have it… it’s sad times for sure, but I guess legally it makes sense. Feel free to share your thoughts in the comments below.

Another example of pushing people around with the law. You have done nothing wrong but I totally understand why you took the links down. Who wants to fight with a law firm with an unlimited budget.
The NHL is really cracking down on all websites with free links to games. They still have not found the site I got to, but I’m sure it will happen soon. Ever since they got the gamecenter thing they are trying to sell they’ve been like the ATF kicking down doors.
Maybe if they lowered the gamecenter price to something reasonable people would buy into it.
myp2p.eu got threatened by a Dutch television group for basically doing the same things this site was doing (posting links to games, yada yada) but it ends up that myp2p won their court case. I dont know if this pertains to you but at least one court out there found that simply posting links was perfectly legal.

Thanks for posting the “cease and desist” order, since it includes the address of the site in question. If your intention in doing that was to continue advertising the site, yet doing so in a legal fashion, it was genius. I learned everything that I needed to know just as easily as if your original post were still up. Bravo.

That’s just a legal form letter, don’t let it scare you. But if you have responded in writing you may have to be accountable for any agreements you have made.
Anyone else interested that is not a company may also want to look into this.
Also foreign sites are USUALLY only held accountable by the copyright laws within that country.
